These Terms of Use ("Terms") govern access to and use of OpenCausation.org, a publicly accessible educational and informational website operated by Causation.com, Inc., a Kansas corporation. In these Terms, "OpenCausation," "we," "us," and "our" refer to Causation.com, Inc.; "Site" refers to OpenCausation.org; "you" or "User" refers to a person or entity accessing or using the Site; and "OpenCausation Content" refers to content and materials made available by or through OpenCausation on the Site.
By accessing or using the Site, you acknowledge that you have read and agree to these Terms. If you do not agree, do not access or use the Site. These Terms are subject to any rights or requirements that cannot lawfully be excluded or limited.
OpenCausation provides publicly accessible educational and informational content concerning causation analysis, methodology, evidence evaluation, and related subjects. The Site is intended to assist users in understanding causation concepts and frameworks.
The Site does not currently require registration, user accounts, subscriptions, payments, document uploads, or the submission of identifying information to access public educational content.
OpenCausation may provide general educational materials, references, explanations, illustrations, and methodological resources. The availability of content does not create an obligation to provide any particular material, feature, update, service, response, or level of availability.
OpenCausation is not acting through the Site as a healthcare provider, law firm, attorney, insurer, claims administrator, adjudicator, governmental agency, or retained expert. The Site and OpenCausation Content are provided solely for general educational, informational, methodological, and organizational purposes.
The Site does not provide individualized medical advice, legal advice, claims decisions, adjudicatory decisions, expert opinions, or individualized causation determinations. Content may not address all relevant facts, scientific evidence, legal standards, jurisdictional requirements, or circumstances applicable to a particular individual, condition, claim, or dispute.
You are solely responsible for verifying information, obtaining appropriate professional advice, exercising independent judgment, complying with applicable laws and professional standards, and determining whether and how any content should be used. Nothing on the Site creates a physician-individual relationship, attorney-client relationship, expert engagement, insurer-insured relationship, fiduciary relationship, or other professional relationship with OpenCausation.

The Site is not designed to receive protected health information, identifiable medical records, confidential claim information, privileged communications, work product, or other sensitive case materials. Do not submit such information through the Site or ordinary email.
Submission of protected health information, identifiable medical records, confidential case materials, privileged communications, or similar sensitive information through an undesignated website or ordinary email channel is unauthorized.
Receipt of unauthorized information does not, by itself, create a physician-individual relationship, attorney-client relationship, business-associate relationship, fiduciary duty, or other special professional or confidentiality relationship beyond duties imposed by applicable law. OpenCausation does not represent that ordinary website access, email, or general contact tools are HIPAA-compliant communication channels.
Subject to these Terms, OpenCausation grants you a limited, revocable, nonexclusive, nontransferable, and nonsublicensable license to access the Site and view OpenCausation Content for personal, educational, research, informational, and internal professional-reference purposes.
You may download or print materials only where the Site expressly permits doing so and only for the purposes stated above. You may share links to publicly available OpenCausation webpages and quote limited excerpts with appropriate attribution, provided that you do not misrepresent the content, remove applicable notices, or imply endorsement by OpenCausation.
All rights not expressly granted in these Terms are reserved by OpenCausation and its licensors.
OpenCausation Content, including text, graphics, visualizations, methodologies, templates, designs, organization, selection, arrangement, trademarks, service marks, and other materials, is owned by or licensed to Causation.com, Inc. and is protected by copyright, trademark, trade-secret, and other applicable laws.
Except as permitted by these Terms or applicable law, you may not substantially reproduce, republish, distribute, sell, license, modify, translate, create derivative works from, publicly display, or otherwise commercially exploit OpenCausation Content.
You may not use OpenCausation Content to create, populate, train, test, benchmark, support, or promote a competing product, database, artificial-intelligence system, publication, or content repository without prior written authorization.
Automated bulk extraction, scraping, mirroring, aggregation, or reproduction of OpenCausation Content is prohibited. Ordinary search-engine crawling, indexing, and linking are permitted when conducted in accordance with OpenCausation's published technical controls, including robots.txt, metadata directives, and other access controls.
Nothing in these Terms restricts rights available under applicable law, including fair use.
You may not:
1. Use the Site for unlawful, fraudulent, harmful, abusive, or deceptive purposes;
2. Interfere with, disrupt, damage, overload, or attempt to gain unauthorized access to the Site, related systems, or networks;
3. Introduce viruses, malware, harmful code, or other technically damaging material;
4. Circumvent security, access-control, rate-limit, content-protection, or other technological measures;
5. Misrepresent your identity, affiliation, endorsement, or relationship with OpenCausation;
6. Systematically scrape, extract, mirror, reproduce, index, harvest, or data-mine OpenCausation Content except as expressly permitted by these Terms; or
7. Infringe or violate intellectual-property, privacy, confidentiality, privilege, contractual, or other legal rights.
OpenCausation may block or restrict access when it reasonably believes that a user has violated these Terms, interfered with the Site, created a security risk, or engaged in unlawful or harmful conduct.
The Site may link to or display content from third-party websites, publications, databases, or services. A link does not mean that OpenCausation controls or endorses the third party's content, products, services, security, or privacy practices.
To the extent permitted by law, OpenCausation is not responsible for the content, accuracy, availability, security, privacy practices, terms, products, services, or conduct of third-party websites or services. Access to third-party resources is at your own risk and is governed by the third party's terms and policies.
OpenCausation may modify, update, suspend, restrict, or discontinue all or any part of the Site or OpenCausation Content at any time, with or without notice. OpenCausation does not guarantee that the Site, any particular content, or any feature will remain available, current, unchanged, uninterrupted, or error-free.
To the extent permitted by law, OpenCausation is not liable for modification, suspension, restriction, interruption, or discontinuation of the Site or any content.
OpenCausation's Privacy Policy describes information practices associated with the Site and is available through the Privacy Policy link on the Site.
OpenCausation provides the Site and OpenCausation Content on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, OpenCausation and its officers, directors, employees, contractors, agents, licensors, suppliers, service providers, and affiliates disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, quality, correctness, completeness, comprehensiveness, suitability, availability, security, and compatibility.
OpenCausation does not warrant that content is current, peer reviewed, applicable to a particular individual or jurisdiction, or free from errors, omissions, interruptions, harmful components, or security risks. You assume the risks associated with accessing and using the Site and OpenCausation Content.
Information transmitted through the internet or electronic communications may be subject to delays, delivery failures, data corruption, unauthorized access, and other risks inherent in electronic communications. OpenCausation is not responsible for third-party hardware, software, websites, applications, platforms, or networks.
To the maximum extent permitted by applicable law, OpenCausation and its affiliates, and their respective directors, officers, employees, contractors, agents, licensors, suppliers, and service providers, will not be liable for indirect, incidental, consequential, exemplary, punitive, special, or similar damages arising out of or relating to the Site, OpenCausation Content, these Terms, or your use of or inability to use the Site.
To the maximum extent permitted by applicable law, OpenCausation’s total aggregate liability will not exceed $100 or the amount you paid OpenCausation for the applicable service during the preceding 12 months, whichever is greater, unless a separate written agreement expressly provides otherwise.
Any claim arising out of or relating to use of the Site must be brought within one year after the event giving rise to the claim, unless applicable law requires a longer period.
To the extent permitted by law, you agree to indemnify and hold harmless Causation.com, Inc. and its officers, directors, employees, contractors, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Site, your material violation of these Terms, your infringement of another person's rights, or information you submit without legal authority.
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws principles, except to the extent federal law or other applicable law requires otherwise.
Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or the Site must be brought exclusively in a state or federal court located in Kansas, and you consent to personal jurisdiction and venue in those courts.
OpenCausation may revise these Terms from time to time. Revised Terms become effective when posted unless a later effective date is stated. The "Last Updated" date will be revised when changes are posted.
Your continued use of the Site after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law. If you do not agree to revised Terms, stop using the Site.
Complete Agreement. These Terms constitute the entire agreement between you and OpenCausation concerning access to and use of the Site, except to the extent a separate written agreement expressly applies and states that it controls.
Assignment. You may not assign or transfer these Terms without OpenCausation's prior written consent. OpenCausation may assign or transfer these Terms, in whole or in part, subject to applicable law.
Notices. OpenCausation may provide notices concerning these Terms by posting them on the Site or by other reasonable means. Notices to OpenCausation must be sent to the contact address identified below.
No Waiver. Failure to enforce a provision of these Terms does not waive the right to enforce that or any other provision later.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
Survival. Provisions that by their nature should survive termination or cessation of use will survive, including provisions concerning ownership, restrictions, disclaimers, limitations of liability, indemnification, governing law, venue, and general provisions.
OpenCausation provides this contact channel primarily for administrative communications, questions concerning the operation of the Site or these Terms, privacy requests, notices of possible copyright infringement, and other legal notices. Such communications may be sent to info@causation.com.
OpenCausation does not currently solicit general feedback, proposed content, manuscripts, research submissions, business proposals, case-specific questions, requests for individualized causation analysis, or requests for medical or legal advice through the Site or ordinary email. OpenCausation has no obligation to review, acknowledge, respond to, retain, return, publish, or act upon any communication.
Do not submit protected health information, identifiable medical records, confidential claim materials, privileged communications, trade secrets, proprietary business information, or other sensitive information through ordinary email. Ordinary email is not represented to be secure or HIPAA-compliant. Submission of a communication does not create a physician-patient, attorney-client, consultant-client, fiduciary, advisory, or other professional relationship.
Unsolicited feedback, comments, ideas, or suggestions that are nevertheless submitted voluntarily must not be submitted on a confidential or proprietary basis. To the extent that intellectual-property or other rights exist in such unsolicited feedback or suggestions, the sender grants Causation.com, Inc. a worldwide, perpetual, irrevocable, nonexclusive, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, incorporate into other materials, create derivative works from, and otherwise use them for any lawful purpose without compensation, attribution, approval, or accounting.
The preceding license does not apply to Personal Information, privacy requests, copyright notices, or other legal notices, which will be handled in accordance with the OpenCausation Privacy Policy and applicable law. Personal Information included in any communication will be processed as described in the Privacy Policy.
